Frequently asked questions

How much do I get if I work on a regular holiday?

You get 200% of your daily wage for the first 8 hours. If the holiday is also your rest day, you get 260%. Overtime is paid 30% more than the hourly rate for that day.

Am I paid on a regular holiday if I don't work?

Yes, 100% of your daily wage, as long as you reported to work or were on paid leave on the workday before the holiday. If the day before was your rest day or a non-working day, the condition applies to the workday before that.

Am I paid on a special non-working day?

Only if you work, unless your company policy or CBA says otherwise ("no work, no pay"). If you work, you get 130% of your daily wage for the first 8 hours, or 150% if it is also your rest day.

How is overtime pay computed?

Overtime is work beyond 8 hours a day. On an ordinary working day you get 25% more than your hourly rate. On a rest day, special day or regular holiday you get 30% more than the hourly rate for that day, which already includes the holiday or rest day premium.

How much is night shift differential?

An extra 10% of your hourly rate for that day, for each hour worked between 10:00 p.m. and 6:00 a.m.. On a holiday or rest day it is computed on that day's higher hourly rate, and during overtime on the overtime rate. For example, night work on a regular holiday is paid at 200% × 110% = 220% of your basic hourly rate.

I am paid monthly. What daily rate should I use?

Ask your HR or payroll which daily rate they use. DOLE's suggested formula is daily rate = monthly salary × 12 ÷ factor, where the factor is the number of paid days in a year: 365 if you are paid every day of the month, including rest days and holidays, or 313 if you are not paid for rest days. Employers may use a different factor.

Who is not covered by these rules?

The Labor Code's rules on hours of work, overtime, night differential, rest days and holidays do not cover government employees, managerial employees, field personnel, members of the employer's family who depend on him for support, domestic helpers and persons in the personal service of another, and workers paid by results, as defined by DOLE regulations. Also, retail and service establishments regularly employing fewer than 10 workers do not have to pay regular holiday pay, and retail and service establishments regularly employing not more than five workers do not have to pay night shift differential.
